Spotdelight Auctions House is a technology platform that connects Hosts (sellers, consignors, or their representatives) with Bidders (buyers). Spotdelight Auctions House is not the seller, auctioneer, agent, appraiser, escrow agent, or party to any sale. Every auction is conducted by, and every lot is offered by, the Host. All descriptions, images, conditions, provenance, authenticity claims, valuations, reserves, buyer's premiums, taxes, shipping, and post-sale communications are the sole responsibility of the Host.

Spotdelight Auctions House does not inspect, authenticate, appraise, insure, or take custody of any lot. Spotdelight Auctions House makes no representation or warranty, express or implied, regarding any lot, Host, or Bidder.

You must be at least 18 years old and legally able to enter a binding contract in your jurisdiction. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account (including bids placed from it, whether by you or anyone else). Impersonation, shared accounts, automated bidding scripts, and multi-accounting are prohibited.

Spotdelight Auctions House may refuse, suspend, or terminate any account at any time, with or without notice, including for suspected fraud, chargebacks, shill bidding, non-payment, harassment, or violation of these Terms.

Each lot has a starting bid, a bid increment schedule, and an ending time. Bids are placed in the Platform's displayed currency and are binding, irrevocable offers to purchase the lot at the bid amount plus any buyer's premium, taxes, and fees. Placing a bid you cannot or do not intend to pay is a material breach of these Terms.

Minimum increments. Bids must meet or exceed the current bid plus the applicable increment. The default increment schedule is: $50 below $500, $100 below $1,000, $200 below $3,000, and $250 at or above $3,000. Hosts may set custom increments per lot.

Soft close. If a bid is placed inside the soft-close window (default the final seconds of a lot), the lot's ending time may be extended by the auction's bid-extension window to prevent last-second sniping. Extensions repeat as long as new qualifying bids arrive.

Reserve. A reserve is the confidential minimum price the Host will accept. If the highest bid at close does not meet the reserve, the lot passes unsold. Hosts may lower or waive reserves at their discretion.

Winning. When a lot closes with a qualifying high bid at or above the reserve, the highest bidder is the winner and a binding contract of sale is formed between that Bidder and the Host. Spotdelight Auctions House records the winning bid, bidder number, and timestamp as authoritative evidence.

Each auction may include a buyer's premium — a percentage set by the Host and disclosed on the auction and lot pages before bidding. The winning Bidder pays the hammer price plus the buyer's premium, plus any applicable sales tax, VAT, GST, duties, shipping, insurance, handling, payment processing, and other charges. All such amounts are the Bidder's responsibility.

Platform commission (Hosts). Hosting on Spotdelight Auctions House is free — there are no setup fees, listing fees, or monthly subscription fees. Spotdelight Auctions House charges Hosts a volume-based platform commission on the hammer price of each completed lot, calculated automatically at the time the lot closes based on the Host's cumulative hammer sales over the trailing 365 days:

• $0 – $500,000 in annual hammer sales: 4.5%
• $500,001 – $2,000,000: 2.5%
• $2,000,001 – $10,000,000: 1.5%
• Over $10,000,000: 1.0%

The commission is deducted from Host payouts. Spotdelight Auctions House may revise the tiers or rates prospectively on notice posted to the site; the rate in effect at the time a lot closes governs that lot. These fees do not create any relationship of agency, partnership, joint venture, or employment between Spotdelight Auctions House and the Host.

Payment is arranged directly between the Host and the winning Bidder, in the manner the Host specifies in the auction terms. Bidders must pay within the timeframe the Host requires (default: within 3 business days of the lot closing). Late or failed payment may result in cancellation of the sale, resale of the lot at the defaulting Bidder's risk, chargeback of any refunded amounts, suspension of the account, and collection of the full amount due plus costs and reasonable fees.

Shipping, collection, export, import, customs clearance, insurance during transit, and risk of loss are governed by the Host's terms for the specific auction. Title and risk of loss transfer when the Host specifies — typically on receipt of cleared payment. Spotdelight Auctions House is not responsible for any loss, damage, delay, or non-delivery.

All lot descriptions, photographs, conditions, estimates, provenance, attributions, and authenticity statements are provided by the Host. They are opinions, not statements of fact, and are provided "AS IS" and "WITH ALL FAULTS."Spotdelight Auctions House does not warrant that any description is accurate, complete, current, or error-free.

Bidders are solely responsible for satisfying themselves, before bidding, as to the nature, condition, authenticity, legal status, and value of any lot — including by in-person or expert inspection where offered. Bidding constitutes acceptance of the lot in its condition at the time of the sale.

By listing a lot, the Host represents and warrants that:

• they have full legal title and the right to sell the lot, free of liens, encumbrances, or third-party claims;
• the lot is not counterfeit, stolen, or subject to any export, import, cultural property, endangered species, or sanctions restriction;
• all descriptions, images, condition reports, and disclosures are accurate and not misleading;
• they will honor the winning bid, communicate promptly with the winner, provide a legitimate invoice, and deliver the lot as described;
• they will not engage in shill bidding, bid on their own lots, coordinate with other Hosts or Bidders to manipulate prices, or use undisclosed alternate accounts.

The Host indemnifies Spotdelight Auctions House and holds Spotdelight Auctions House harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from a breach of these warranties or from any lot they list.

By placing a bid, the Bidder agrees to:

• honor every bid as a binding offer;
• pay the hammer price, buyer's premium, taxes, and shipping in full and on time;
• not retract, withdraw, or modify a bid once placed;
• not coordinate with other Bidders, Hosts, or third parties to suppress prices, rig outcomes, or share bidding accounts;
• not use scripts, bots, scrapers, or automated bidding tools without prior written permission from Spotdelight Auctions House;
• not chargeback, dispute, or reverse a payment for a lot they in fact won and received as described.

Auctions may include live host video, audio, chat, and screen sharing. By participating you consent to the recording and retention of such streams for fraud prevention, dispute resolution, quality, and legal compliance. You must not upload, stream, or transmit unlawful, infringing, harassing, defamatory, obscene, or otherwise objectionable content. Spotdelight Auctions House may remove content, terminate streams, and terminate accounts at its discretion.

Any dispute over authenticity, condition, non-delivery, payment, chargeback, return, refund, or performance of a sale is between the Host and the Bidder. Spotdelight Auctions House is not a party to those disputes and has no obligation to mediate, arbitrate, refund, credit, replace, or otherwise resolve them. Spotdelight Auctions House may, at its sole discretion, provide records (bid history, timestamps, messages, PDF receipts) to assist the parties or law enforcement, but is not obligated to do so.

Hosts may edit or withdraw a lot before it opens for bidding. Once bidding is open, Hosts should not withdraw a lot except as required by law, safety, or a material factual error, and must accept responsibility to all Bidders who have placed bids. Spotdelight Auctions House may cancel, pause, close early, or void a lot or auction at any time — including for suspected shill bidding, technical failure, error in listing, disputed ownership, sanctions or legal risk, or violation of these Terms. Voided results are not binding.

The Platform is provided on a best-effort basis. Spotdelight Auctions House does not warrant that the Platform will be uninterrupted, secure, timely, or error-free. Bids may be lost, delayed, misdisplayed, or timestamped incorrectly due to network, browser, device, or server issues. Spotdelight Auctions House's server-side record is the authoritative record of every bid, extension, and closing time. Spotdelight Auctions House is not liable for any bid that fails to reach the server, or for any auction outcome affected by a technology fault.

You are responsible for all taxes, duties, and levies arising from your use of the Platform and from any sale you participate in. You will comply with all applicable laws, including anti-money-laundering, sanctions, export control, consumer protection, cultural property, and endangered species laws.

The Platform, its software, design, branding, and content (excluding user submissions) are owned by Spotdelight Auctions House and its licensors. You may not copy, reproduce, reverse engineer, scrape, or create derivative works of the Platform without prior written consent. By submitting content (lot descriptions, images, video, audio, messages) you grant Spotdelight Auctions House a worldwide, royalty-free, sublicensable license to host, display, reproduce, modify, and distribute that content for the purpose of operating and promoting the Platform.

The Platform and all lots, listings, and content are provided "as is" and "as available," without warranty of any kind, express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, authenticity, quiet enjoyment, or that the Platform will meet your requirements.

To the maximum extent permitted by law, Spotdelight Auctions House, its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, use, or business, arising out of or in connection with your use of the Platform, any auction, or any lot, whether based in contract, tort, strict liability, statute, or otherwise, even if advised of the possibility of such damages.

Spotdelight Auctions House's total aggregate liability for any and all claims arising out of or relating to the Platform or these Terms is limited to the greater of (a) the fees you paid to Spotdelight Auctions House (not to a Host) in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

You will indemnify, defend, and hold harmless Spotdelight Auctions House, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to (i) your use of the Platform, (ii) any lot you list, bid on, buy, or sell, (iii) your breach of these Terms, (iv) your violation of any law or the rights of any third party, or (v) any content you submit.

Spotdelight Auctions House processes personal data (contact details, bid history, device data, payment metadata, streaming recordings) to operate the Platform, prevent fraud, comply with law, and improve the service. Hosts may see limited winner contact information for lots they sold, solely to fulfill the sale. Do not use another user's data for any purpose other than completing a transaction.

Spotdelight Auctions House may update these Terms at any time. Material changes take effect when posted, and your continued use of the Platform after posting constitutes acceptance. If you do not agree, stop using the Platform.

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any dispute between you and Spotdelight Auctions House shall be resolved exclusively by binding individual arbitration administered by a recognized arbitral institution in Wilmington, Delaware, and you and Spotdelight Auctions House waive any right to a jury trial or to participate in a class, collective, or representative action. Nothing in this clause prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect its intellectual property rights.

These Terms are the entire agreement between you and Spotdelight Auctions House with respect to the Platform and supersede any prior agreement. If any provision is held unenforceable, the remainder remains in effect. Failure to enforce any right is not a waiver. You may not assign these Terms without Spotdelight Auctions House's prior written consent; Spotdelight Auctions House may assign them freely. Section headings are for convenience only.
